There is a lot of misinformation on the web regarding a ‘quick and easy’ divorce. In fact, in California a divorce takes a minimum of 6 months and one day from the date of service. That’s as quick as it gets! The other misconception is that divorce is ‘easy’. In fact, there is nothing ‘easy’ about divorce. Here are the aspects of divorce that many ads do not tell you:
1. Legal meanings are not always easy to understand–you need to know your legal rights before you fill out the petition
2. Divorce is a process in which each step must be done sequentially–an error in any one of these steps could result in rejection by the court
3. Agreements on issues must be communicated to the court in a legally acceptable manner or the courts will require an appearance
This 6 month and 1 day time period is the minimum and very often a divorce takes much longer. This occurs because the courts reject the paperwork over and over for different reasons.
Don’t be caught in this cycle of rejection–get the legal advice and oversight that you need to finalize your divorce!
