A Legal Separation is not required in order to file for Divorce in California. In addition, California Divorce laws do not require parties to be separated for a period of time in order to file for Divorce. California Divorce laws do require a ‘date of separation’ and that is the date that the parties no longer live together as husband & wife. Most people choose a Legal Separation for reasons such as:
- Their religion does not allow for Divorce
- There may be financial or healthcare advantages
- They may wish to address assets, debts or custody & support issues in a faster time frame (a Legal Separation can take 3 or 4 months to finalize whereas a Divorce takes a minimum of 6 months and 1 day from the date of service)
- There may be jurisdictional issues (different states involved or a possible move to another state)
- There may be other reasons

Be advised that a Legal Separation will address the issues as in a Divorce, but once finalized, the parties cannot remarry. A Divorce will allow them to remarry.
