Is the other parent not allowing you to see your children?
If you have an existing California court order for child custody & visitation and it is specific, you can ask the police to enforce the order or you can file a Contempt order which would address the non-compliance of the other parent. If your current order is not specific enough & therefore not enforceable, you may need to change the order by filing a Request for Order.
However, if you do not have existing court orders, you would file a Divorce, Paternity Action (if you have children & are not married) or a Legal Separation requesting the court to address child custody, visitation and support. Since it takes months to get to the trial phase, you may want temporary orders so that custody & visitation can be addressed in a faster time frame.
You can get temporary orders by filing a Request for Order. This can be filed when you have:
- filed for Divorce and want a temporary custody & visitation order while the Divorce is in progress
- filed a Paternity Action (when you have children & are not married) and want a custody & visitation order while the Paternity Action is in progress
- filed a Legal Separation and want a temporary custody & visitation order while the Legal Separation is in progress
