The best way to divorce in California is with cooperation. That’s right, when your spouse is cooperative you will spend less money on your divorce! It will also take less time. Further, you won’t need to take time off work in most instances. You will not have to provide a babysitter for children! You won’t have to drive to the court for a hearing or trial! You will also be spared the anguish and stress of fighting with your spouse. Cooperation is the way to go for an easy divorce!

When there is cooperation in a divorce without issues, the process can be even easier. If your marriage is under 10 years, and you have no children or property (no assets or debts) and you do not wish to ask for spousal support, then the divorce can be completed without an agreement. In the vast majority of cases a court appearance is not necessary. A consultation with the Attorney will confirm if your divorce is without issues.

Likewise, if your divorce is one divorce with issues it can still be completed without going to a court hearing or trial when you have cooperation. If you have real estate or other assets such as retirement funds or investment funds, you and your spouse will need to agree on how to divide these assets. In addition, if you have children then custody, visitation and support will also have to be agreed upon. There may be other issues such as spousal support, division of debt etc. A consultation with the Attorney will determine the issues.

Once both parties agree on the issues, the Attorney will prepare an agreement that will then be sent to the court with the final divorce documents. In the vast majority of uncontested divorces, a hearing or trial is not necessary. In addition, an uncontested divorce is usually finalized within the 6 months and 1 day time frame from the date of service.

We at Legal Action Workshop strive to make the divorce process as easy as possible. In line with this, we offer phone consultations for convenience. In effect, many ‘uncontested’ divorces can be completed by phone and email from the comfort of your home or office.
