My dad is 82 years old. Retired at 78. Married in Jan 2002. She is 66 years old. Retired SEP 2018 with 39 years at Kaiser, and served him Divorce papers. He only draws Social Security $700.00 month. She left him in surmountable debt. He needs spousal support now. He is not educated. Can he file for spousal support now?

It’s best to have an attorney look at the petition to determine what his spouse wants. Does his spouse work? Debt that is accumulated during the marriage is also community debt and can be divided in the divorce settlement.
