A parent or parents cannot give up rights to their children except under certain circumstances.1. if both parents agree to the children being adopted (either an independent adoption or a step-parent adoption) or if it is determined that the parents have abandoned the children and therefore an adoption is approved by the court
2. if both parents agree to a guardianship or if the courts determine that a guardianship is appropriate since parents are unable to care for their children for a certain period of time
3. if a child aged 16 or over files for emancipation
