Although Divorce is never easy, it can be made easier if you understand how a California Divorce works. Basically, there are 3 types of Divorces:
- Default Divorces (the respondent does not respond); there are 2 types: defaults with issues or defaults without issues
- Uncontested Divorces (the parties agree on issues & are cooperative)
- Contested Divorces (the parties are not cooperative)
If you have a Default or Uncontested Divorce you have what is considered an ‘easy’ California Divorce. This type of Divorce is usually finalized within the 6 months & 1 day from the date of service and can be completed for a reasonable fee. Look for an experienced Divorce Lawyer who offers a flat rate.
Contested Divorces are more difficult and more costly. If one or both parties are self-employed or if there are financial or asset/debt issues, Attorneys may need to do discovery which may include depositions. Further, parents may have custody & support issues which can be costly and time-consuming.
It is best to meet with an experienced Divorce Lawyer so you understand which type of Divorce you have and how easy it will be to finalize.
