You or your spouse must be a resident of California to file (live in California for at least 6 months and in the county for at least 3 months).

Our experienced attorneys have completed thousands of Legal Separations. We save our clients both time and money. Remember, in California it is not necessary to file for a Legal Separation in order to Divorce.

There are several reasons why people may desire a Legal Separation. If a couple does not believe in Divorce for religious reasons, then they may wish to opt for Legal Separation so that property issues, spousal support as well as child custody, visitation and support can be addressed. 

 

They may also wish to file for Legal Separation for financial reasons, health insurance reasons or for separation of debt etc. In any case, a Legal Separation will address the same issues as in a Divorce. The difference is that the couple will not be divorced and hence could not remarry.

The issues of the Legal Separation can be agreed upon by the parties so that a court appearance is not necessary. Your Attorney will explain your options.

 

If your spouse responds when served, your Attorney will explain your options.  If your spouse wishes to finalize the Legal Separation by agreeing on issues, a Legal Separation Agreement can be prepared.  Additional low flat fees will apply.
